Please read these Terms & Conditions carefully before using www.thegownlounge.com.au (the Website) to browse or buy items.

ABOUT THE WEBSITE

The Gown Lounge sells fashion clothing items under two main criteria, New With Tags (never worn) and second-hand. The Gown Lounge is not affiliated with or endorsed by any designer, manufacturer, retailer or brand of items for sale. The Gown Lounge also offers a Brisbane located, home-based local gown hire service, viewable via the Website and transacted upon in store only.

By using our Website (www.gownlounge.com.au) or related social media platforms owned and operated by us, including making a purchase through the Website or through the physical, home-based store in Brisbane, or hiring a gown (collectively the Services), you agree to be legally bound by these Terms & Conditions (Terms).

The Gown Lounge reserves the right to modify these Terms from time to time at our discretion and without notice to any party. All visitors and users of our Website are responsible for reviewing this page periodically and familiarising themselves with the Terms & Conditions that apply at that point in time.


Your continued use of the Website or our Services after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the Website or the Services.

The Gown Lounge reserves the right, at its sole discretion to block or ban anybody who is in violation of these Terms & Conditions or any other policies contained in the Website from using the Website or any of it Services.

USE OF THE SERVICES

Our Services, including but not limited to the registration of an account with us or placing of an order, is not intended to be used by children under the age of 18. If you are under 18, any use of our Services must be with the involvement of a parent or guardian. By accessing or using our Services, you warrant and represent to us that you have read, understand and agree to be bound by these Terms and that you are over the age of 18 years of age, have the right, authority and legal capacity to enter into a legally binding agreement and to abide by these Terms.

You agree that you are responsible for your access to our Services and for ensuring that any persons that may access the Services through your internet connection are aware of and compliant with, these Terms.

When you provide your details to us, you warrant and represent that the details are accurate and that you are the account holder or authorised nominee of the contact number that you provide to us.  You consent in advance to being contacted during our usual business hours for matters in relation to customer service and order confirmation/assistance.

The item descriptions and prices we charge for our clothing is listed on the website. When using our Service to purchase an item, you agree that:

(i) You are responsible for reading the full item listing before making a commitment to buy it;

(ii) You enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

The prices we charge for our clothing is listed on the website. We reserve the right to change our prices for items displayed at any time, and to correct pricing errors that may inadvertently occur. 

All of our Terms & Conditions and Policies that are linked to, or in the Website, including our Privacy Policy, are incorporated into these Terms. You agree to comply with all such Terms when accessing or using our Services.

PURCHASE TRANSACTIONS

The Gown Lounge sells new and used clothing via its website and its associated social media platforms. All prices and fees are quoted in Australian dollars. Buyers are responsible for paying the correct postage costs associated with every order and any consequent item return by mail.

To make an online purchase the buyer can either create an account or check out as a guest. Both methods require a valid credit card or Paypal account. As an account holder, to enable you to conveniently make additional purchases, we may store and update your payment method on file.


The availability of items for sale and listing prices are subject to change at any time without notice.

 

The Gown Lounge reserves the right, in its sole discretion, to limit the amount of time an item may remain in a customer’s shopping cart.

 

We aim to avoid any mistakes but if an item is listed at an incorrect price or contains incorrect information we reserve the right, at our sole discretion, to refuse or cancel any orders placed for that item.


After you have paid for your items, The Gown Lounge will issue you with a receipt to confirm that your payment has been received. We may record your purchase details for future use. By agreeing to pay for a transaction with your credit card, you therefore authorise us to charge your credit card.

Please note that you cannot cancel or amend an online order after the payment process has completed (except as required by Australian Consumer Law).

HIRE TRANSACTIONS

By hiring a gown from The Gown Lounge, you are accepting and consenting overall to the practices in these Terms & Conditions. You agree that you are renting products from The Gown Lounge (Us) and ownership of the product remains with us at all times. Our products may be rented for customers who are under the age of 18 however we only rent directly to adults who may rent the products on behalf of a minor. 

Payment Terms for Hiring

The “hire price” for the product will be the hire fee only, not inclusive of a 'bond', nor the cost to customer of picking up the gown and delivering it back. By agreeing to hire, you authorise The Gown Lounge to charge you the listed retail value/purchase price of the gown, with the difference between hire fee and retail value (herein referred to as the Bond) to be refunded when the gown is returned in the agreed hire period and in an undamaged, unmarked condition.

Cleaning during Hire

Professional cleaning is included in your hire and you agree that no attempts will be made to clean, alter, iron/press garment/s (unless otherwise arranged). Certain fabrics are more prone to wrinkles though, and if you need to remove slight creases, please try steaming the garment on low heat with no direct contact to the steaming element. 

Hire Return Condition Criteria

You agree to treat our products like you would your own. You will treat the garment with the upmost of care. Minor soiling of the gown hemline and lining hemline is expected. Body perspirant marks under the arm are expected. Minor soiling due to fake tan and makeup is expected. However, if the gown is soiled by alcohol, food, coloured fluids or body waste, you agree to forfeit the return of the Bond as compensation for the specialised cleaning cost or garment replacement.

Late Fee Policy

You agree to return the gown within the four day hire period with Day 1 considered the day of hire/pick up. Actual return time of gown on the due date will be discussed personally and agreed upon at our sole discretion. If you return your item/s late, you will incur a $30 late fee for every day you are late, and being charged out of the retained Bond amount. If the gown is more than 3 days overdue for return, The Gown Lounge will consider it as a non-return and you forfeit your entire Bond.

If you return your hire gown by Auspost satchel, it must be received within the hire period unless otherwise agreed. An AusPost tracking number must be supplied. The Gown Lounge bears no responsibility for any lost or damaged packages during the hire period. If the satchel is undelivered and after reasonable steps have been taken to track it with AusPost, it will be considered a non-return and you forfeit your entire Bond.

Cancellation of Hire Transaction

The Gown Lounge will not accept cancellation requests. Under certain conditions and at our discretion, we may agree to a hire cancellation and refund within 12 hours.

TERMINATION OF A CUSTOMER ACCOUNT OR SERVICE

If you wish to terminate your account, you may do so by notifying The Gown Lounge at any time by sending an email to gownlounge@optusnet.com.au. The Gown Lounge may at any time, in its sole discretion:

i)  cancel unconfirmed or inactive accounts at any time and reserves the right to refuse service to anyone, for any reason, at any time.

ii) terminate your account and registration if you have breached any provision of the Terms and Conditions or if we can no longer provide our service.

WARRANTY & RETURNS

The Gown Lounge will refund or exchange a purchase only if:

i)    the item is found to have a manufacturing defect;
ii)   was not represented accurately in the item description;
iii)   you received a different item to what was ordered; and
iv)   the item is returned unworn, unmarked & with original tag intact 

To lodge a return claim you must contact The Gown Lounge within 10 business days from date of purchase.

The Gown Lounge will at its sole discretion, either refund or substitute an item free of charge to you. We will pay for the standard delivery of the substituted item to you if your claim has been successful.
